General terms of hiring of a furnished apartment located at Collemoine, 21390 Vic sous Thil, France 1. General provisions, use of the places Apartment « no smoking » The tenant will enjoy the hiring in a peaceful way and will put to good use of it, in accordance with the destination of the places. The tenant commits himself returning furnished, with his departure, as own and arranged as it will have found it on his arrival. The hiring cannot in no case to profit with thirds. All the installations are in operating condition and any claim with regard to them occurring more 24:00 after the entry in pleasure of the places, could not be allowed. The repairs made necessary by the negligence or bad maintenance in the course of hiring, will be the responsibility of the taker. Obligation to take care that the peace of the vicinity is not disturbed by the fact of the taker or his family. The owner will provide housing in conformity with description that it made some and will maintain it in a position to be useful. 2. Arrival - Departure The arrivals are done between 2 p.m. and 18 hours. The departures take place between 8 a.m. and 11 hours. The inventory and inventories of fixtures are done on arrival and departure during these time slots. Inventory and inventory of fixtures The inventory of fixtures as well as the inventory of furniture and the equipment will be made contradictorily at the beginning and the stay by the owner (or his representative) and the tenant and will carry the signature of the two parts. The buildings are rented furnished with material with kitchen, crockery, glassmaking, covers and pillows, such as they are in the descriptive state herewith. If it is necessary, the owner or his representative will be in right to claim with the tenant with his departure, the price of the cleaning of the rented buildings (fixed contractually, see the tariff) the total bill at the cost of replacement of the objects, furniture or, notched, cracked broken materials or deteriorated and those whose wear would exceed the normal for the duration of the hiring, the price of cleaning of the covers made dirty, an allowance for deteriorations of any nature concerning the curtains, wallpapers, ceilings, carpet, carpets, panes, bed linen, etc… In the event of not-realization of inventory of fixtures, because one time of departure other than that envisaged with the contract and incompatible with his timetable, the owner will unilaterally carry out the inventory of fixtures during the starting time slot envisaged, and will return the guarantee in the 10 days which follow the departure in the absence of degradation and subject to good repairing of the places (household understood). If the owner notes damage, it will have to inform of it the tenant by registered letter with acknowledgment of delivery under about eight. Consequently, it will have a 2 months deadline after the starting date to restore the guarantee deduction made of the damage, the loss of the objects, etc With regard to duly noted deteriorations, they will be the object of a reserve on the guarantee whose amount will be determined by friendly agreement between the owner and the tenant. In the event of litigation, an estimate will be carried out by a professional. The tenant will not be able to be opposed to the visit of the buildings, when the owner or his representative makes the request of it. 6. Insurances The tenant is held to ensure the room which is entrusted to him or rented. He must thus check if the contract of insurances of its principal residence envisages the extension holiday (hiring of vacancies). On the contrary assumption, it must subscribe the extension necessary. 1

7. Deposit or guarantee and service additional The amount of the deposit is equal to the amount of the hiring with a minimum of perception of 200 €. In order not to penalize the stays longer, a maximum of perception is applied, that is to say 500 €. It is paid at the latest at the time of the entry in the places. In general, it is given back to the tenant after 8 days, deduction made, in the event of degradation of the elements of furnished and the goods placed at the disposal, of the possible expenses of replacement or repairing. If the guarantee is not sufficient, the tenant commits himself perfecting the sum after the inventory of exit. The additional services will be invoiced in supplement (see tariff). 8. Payment The amount of the down payments is of 30% of the price of the hiring. The reservation becomes effective since the tenant will have turned over two specimens of this contract, signed and accompanied by the amount of the down payments, before the date indicated on the contract. The pay of the hiring will be versed at the latest 30 days before the date of arrival with furnished. If the tenant delays his arrival, it must warn the owner as a preliminary and forward to him of it the balance of the rent for the date of the beginning of the hiring initially envisaged; under these conditions, it will not be made application of article 9. 9. Interruption of the stay In the event of anticipated interruption of the stay by the tenant, and if the responsibility for the owner is not put in question, will not be carried out to any refunding, except that of the deposit under the conditions indicated to article 6 10. Conditions of cancellation Any cancellation must be notified by registered letter 30 days before the entry in pleasure. In general, the down payments remain sure with the owner; however, they can be restored when furnished can be relet for the same period and at the same price. If the tenant did not present himself the day mentioned on the contract, passed deadline a 24 hours and opinion notified to the owner: - This contract is regarded as cancelled, - The price of the hiring remains sure with the owner, - The owner can have furnished sound. In the event of cancellation of the hiring by the owner: - It will refund with the tenant the double of the amount of the received down payments. An early retirement could not cause any refunding. However this departure which can be moved by a case of absolute necessity, the subscription of a contract of insurance cancellation can make it possible to the tenant to be secured some. 11. Maintenance in the places The tenant will be able in no circumstance to prevail himself of any right to the maintenance in the places with the expiry of the period of hiring initially envisaged on this contract, except agreement of the owner. Any maintenance after the fixed date and the hour involves the total confiscation of the deposit. A complement of hiring are equivalent to once and half the paid rent, of the damage for deprivation of pleasure towards the owner or his have-rights, of the payment of the expenses of hotel, the expenses of search of hotel and all other consecutive expenses to this serious error. The owner, represented by the legal tenant on standby, request expressly with the police to make evacuate the places without another opinion or authorization, with the simple sight of the dates and hours stipulated on this contract with a grace period one hour. Request is also made lodge of a complaint for reason for illegal occupation of dwelling. Only serious health problems, justified by a medical document specifying the maintenance and preventing a transport apart from the rented places can prevent an evacuation of force by the police or the legal tenant. This case would not suspend therefore the refunding, expenses, compensations quoted in this paragraph.
