To what extent is the death penalty a fair sentence?

The death penalty is a very tough sentence, that’s why it may be used with caution. So we may wonder to what extent it is a fair sentence. To answer this question, my outline will be two-fold : first, I will attempt to show that to be fair there are some conditions about the convict and in a second part I will write about the conditions about the judgement and the trial. Capital punishment can be a fair sentence if the crime committed is really important. For example, we can’t condemn somebody to death because he has threatened somebody else. Then, in some cases, when the accused confesses to his crime, it’s easier to return a fair verdict. The convict should also not pay because of racial discrimination and should not have any mental illness. Indeed, he has to be aware of what he did. Finally, some methods of execution amount to torture like the electric chair which is not humane. To condemn somebody to death, many conditions about the judgement are important. First, enough evidence has to be found because without proof, no fair judgement is possible. Nowadays, DNA Testing can be used and can help for example in criminal cases. I also think that it is better if there is an appeal. Then, absolutely no doubt is permitted in the case and the whole story has to be clear. Last but not least, the judgement has to be totally unbiassed and whith no discrimination. To conclude, capital punishment can be a fair sentence if some conditions are respected like if the convict isn’t mentally disabled, if there’s no racial discrimination or if there is enough evidence. So, to my mind, it should be really difficult to return a fair verdict and maybe the judicial system isn’t adapted but we can hope that one day, there will be an ideal judicial system.
